Terms of Service

1. Acceptance of Terms

By accessing or using the Boost eLearning website (boostelearning.com), creating a learner or administrator account, enrolling in a course, or otherwise engaging with our services, you (“User,” “Customer,” or “Learner”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree to these Terms, do not use our services.

2. Description of Services

Boost eLearning provides IT certification training through the following channels:

  • Marketing website: boostelearning.com, including course catalogs, lead-generation forms, the resource library, and free-trial enrollment
  • Training delivery via Learning Management System (LMS): self-paced online courses, live-virtual instructor-led sessions, and on-site instructor-led training delivered to individual learners or enterprise cohorts
  • Supplementary services: practice labs, practice exams, study guides, coaching sessions, and the Pass Guarantee program

We reserve the right to modify, suspend, or discontinue any feature of our services with reasonable notice. For enterprise customers with active service agreements, any material change will be communicated in writing with at least 30 days’ advance notice.

3. Accounts

To access course content through the LMS, you must create a verified account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the confidentiality of your account credentials and not share login access with any other person
  • Notify us immediately at [email protected] of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

Enterprise administrators may provision and manage learner accounts on behalf of their organization. Each provisioned seat corresponds to one named individual and may not be reassigned more frequently than permitted under the applicable enterprise agreement.

4. Acceptable Use

You agree to use Boost eLearning’s services only for lawful purposes and in accordance with these Terms. You must not:

  • Share, sublicense, resell, or redistribute course content, materials, or credentials to any third party
  • Scrape, crawl, or systematically download content from the LMS or website using automated tools
  • Use any course content, transcripts, assessments, or materials to train, fine-tune, or evaluate any artificial intelligence or machine learning model
  • Attempt to circumvent access controls, DRM, or authentication mechanisms
  • Impersonate another learner, instructor, or Boost eLearning employee
  • Upload, post, or transmit any material that is unlawful, defamatory, infringing, or harmful
  • Interfere with the security, integrity, or availability of our platform or infrastructure

Violation of these acceptable use provisions may result in immediate suspension or termination of access without refund.

5. Intellectual Property and License

All course content, video lectures, practice labs, assessment questions, study guides, slide decks, and related materials (“Course Materials”) are the proprietary intellectual property of Boost eLearning or its licensors and are protected by copyright, trade secret, and other applicable laws.

License grant: Upon payment and for the duration of your enrollment or subscription term, Boost eLearning grants you a limited, non-exclusive, non-transferable, revocable license to access and use Course Materials solely for your own personal, non-commercial learning and exam preparation purposes.

Course Materials are licensed, not sold. You do not acquire any ownership interest in Course Materials. No rights are granted beyond those expressly stated in these Terms or your executed enterprise agreement.

6. Pass Guarantee

Eligible courses include a Pass Guarantee. Full terms, eligibility criteria, and the retake process are described on the Pass Guarantee page. The guarantee is subject to learner compliance with all attendance, lab completion, and exam attempt requirements.

7. Payment and Billing

7.1 Payment Methods

We accept the following payment methods:

  • Major credit and debit cards (Visa, Mastercard, American Express)
  • ACH bank transfer
  • Purchase Orders (POs) for qualified enterprise and government customers

7.2 Enterprise Net-30 Terms

Qualified enterprise customers may be extended Net-30 payment terms upon credit approval. Invoices not paid within 30 days of the invoice date will accrue interest at 1.5% per month (or the maximum rate permitted by law, whichever is lower). Boost eLearning reserves the right to suspend access for overdue accounts after providing written notice.

7.3 Taxes

All prices are exclusive of applicable sales tax, VAT, or similar taxes unless otherwise stated. You are responsible for all taxes applicable to your purchases in your jurisdiction.

7.4 Refunds

Refund eligibility depends on the product type and delivery modality. Individual self-paced courses may be refunded within 7 days of purchase, provided less than 20% of the course has been accessed. Live-virtual and on-site sessions have cancellation and rescheduling terms specified in the applicable enrollment agreement. Enterprise contracts govern refund and credit provisions for their respective term.

8. Disclaimers

Boost eLearning’s services are provided “as is” and “as available.” To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that: (a) our services will be uninterrupted, error-free, or secure; (b) any defects will be corrected; or (c) course content will guarantee exam passage (except as described under the Pass Guarantee terms). Certification exams are administered by third-party vendors (e.g., CompTIA, Microsoft, Cisco), and exam policies, passing scores, and voucher terms are set by those vendors, not by Boost eLearning.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Boost eLearning and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of our services. Our total aggregate liability for any claim arising under these Terms shall not exceed the amounts you paid to Boost eLearning in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities; in such jurisdictions, our liability is limited to the extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Boost eLearning and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

11. Termination

We may suspend or terminate your account and access to our services at any time, with or without cause, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of our platform. You may close your account at any time by contacting [email protected]. Termination does not entitle you to a refund except as expressly provided in Section 7.4.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [State], without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or our services that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information. Class action lawsuits and class-wide arbitration are waived to the extent permitted by law.

13. Changes to These Terms

We may revise these Terms from time to time. For material changes, we will provide at least 14 days’ advance notice via email to registered account holders. Continued use of our services after the effective date of revised Terms constitutes acceptance. If you do not agree to updated Terms, you must stop using our services before the effective date.
